Terms of Use

MyTherapyNotes is a software tool designed solely for personal organization and summarization of user-provided audio and text content related to therapy sessions or personal reflection.

The App:

• Records audio (subject to user device permissions)
• Transcribes audio into text
• Organizes and structures user content into readable formats (including summaries, key themes, and action items)

IMPORTANT CLARIFICATION: The App does not interpret, diagnose, or evaluate user input. It does not provide psychological, medical, psychiatric, therapeutic, or clinical opinions. All outputs generated by the App are automated structural reorganizations of user-provided content for readability and navigation purposes only.

No content produced by the App should be construed as professional advice of any kind.

The App does not provide and is not intended to provide medical, psychological, psychiatric, therapeutic, legal, or other professional advice, diagnosis, or treatment.

All outputs generated by the App, including but not limited to transcripts, summaries, insights, themes, and action items, are:

• Automatically generated
• Informational in nature only
• Not reviewed by a human professional
• Not a substitute for professional advice or treatment

You are solely responsible for independently verifying any information generated by the App before relying on it.

You represent and warrant that:

• You have obtained all legally required consents before recording any conversation
• You comply with all applicable laws regarding audio recording, privacy, and consent in your jurisdiction
• You will not use the App in violation of any law or regulation

You assume full responsibility for your use of the App and any recordings made through it.

To provide transcription and structured session summaries, the App processes audio recordings and related session content.

Before any recording or session content is transmitted for AI processing, the App clearly explains what data will be shared, identifies OpenAI as the third-party AI provider, and asks for the user's explicit consent.

If the user grants consent:

• The audio recording is transmitted securely via HTTPS/TLS to our backend infrastructure hosted by Supabase.
• The audio recording is sent to OpenAI for speech-to-text transcription.
• The resulting transcript and related session content are sent to OpenAI to generate a structured summary, including themes, insights, action items, and selected quotes.
• This data may contain sensitive personal, health-related, or therapy-related information included in the recording.

The App does not transmit recordings or session content to OpenAI unless the user has provided consent. Users may revoke their AI processing consent at any time in the App's Settings. After consent is revoked, the App will request consent again before another recording is processed.

Audio and session content are used only to provide the transcription and summarization requested by the user. We do not use this content for advertising, profiling, or marketing.

The App may require authentication via third-party services (e.g., Supabase Auth, including email/password and Google OAuth).

You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• Securing access to your device
• All activities occurring under your account

We are not liable for unauthorized access resulting from compromised credentials or devices.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code
• Use the App for unlawful, harmful, or abusive purposes
• Interfere with or disrupt App functionality or security
• Circumvent any security or access control mechanisms

All session outputs (including transcripts and summaries) are stored locally on the user's device only. We do not have access to this data.

You may delete your data at any time using in-app deletion features or by removing the App from your device.

The App uses the following third-party service providers:

• Supabase – account authentication, consent records, and secure backend processing infrastructure.
• OpenAI – speech-to-text transcription and generation of structured session summaries.

These providers receive only the data required to provide the requested App functionality. They are not permitted to use user recordings or session content for advertising, marketing, or unrelated profiling.

We require third-party service providers that process personal data on our behalf to maintain privacy and security protections that are the same as or equivalent to the protections described in our Privacy Policy and to process the data only for the purposes described above.

To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Accuracy of generated outputs
• Non-infringement

We do not warrant that the App will be uninterrupted, error-free, or secure at all times.

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:

• Loss of data
• Loss of profits
• Emotional distress
• Reliance on App-generated content
• Misinterpretation of outputs

Your sole remedy for dissatisfaction with the App is to discontinue use.

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, and employees from and against any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any applicable law or third-party rights

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the App, other users, or third parties.

You may terminate this agreement at any time by discontinuing use and deleting the App.

We reserve the right to modify these Terms at any time. Updates will be effective upon posting of a revised version. Continued use of the App constitutes acceptance of the updated Terms.
